What is a No-Fault Divorce?

In Georgia there are thirteen separate grounds for a divorce.  A no-fault divorce means that either spouse can file for a divorce without having to show the other spouse has done something wrong  which would constitute one of the thirteen grounds for divorce.  All you have to prove is that you have “irreconcilable differences” and that there is no hope for reconciliation.

An uncontested divorce is a divorce where both the husband and wife are able to agree on how to divide all of their possessions and their debts, and if they have children, how to allocate custody, child support and all associated parenting arrangements.  An uncontested divorce avoids a potentially bitter conflict that can prevent you from having a future polite relationship.  Additionally, it is not as psychologically taxing on either party.

What information do I need to provide?

Each divorce is unique and more information will be needed, but initially the following information should be provided.

  • The full name and date of birth of both parties
  • The wife’s maiden name and if she wants her maiden name restored
